2. Scope and acceptance
These Terms apply to bookings made directly on chezvivi.com or through our direct contacts. Bookings made on Airbnb, Booking.com or Vrbo are governed by those platforms' terms and policies; the house rules (clause 7) apply to every stay.
By completing a booking, the lead guest confirms that they have read and accept these Terms, on their own behalf and on behalf of all guests in the booking.
The contract is for local accommodation services under Portuguese Decree-Law 128/2014. It is not a tenancy agreement.
3. Booking, price and payment
- Bookings are subject to availability and are only confirmed after payment and our confirmation email.
- The price shown at booking includes VAT at the applicable rate. The cleaning fee is charged separately and shown before confirmation.
- The Lisbon municipal tourist tax is not included in the price and is charged separately, under the municipal regulation in force. Current rates: https://informacoeseservicos.lisboa.pt/servicos/detalhe/taxa-municipal-turistica
- Payment is made by card, in full, at the time of booking.
- The invoice is issued to the lead guest, or to the company and tax number they provide before check-out.
4. Security deposit
- A security deposit of EUR 300 applies, secured on the card used for the booking.
- If there is no damage, the deposit is released within 7 days after check-out.
- If there is damage, we will inform the lead guest within that period, with photos and a quote or invoice, and charge the same card only the amount needed for repair or replacement. By accepting these Terms, the lead guest authorises that charge.
- The deposit does not cap the guest's liability: if the damage exceeds EUR 300, the difference remains payable.
5. Cancellation and changes
- Cancellation 5 days or more before the check-in date: 100% of the amount paid is refunded.
- Cancellation less than 5 days before check-in, or no-show: the first night is retained and 50% of the remaining nights is refunded.
- After check-in (early departure): no refund for unused nights.
- If the booking is cancelled before check-in, the cleaning fee is always refunded.
- Cancellations must be sent by email to hello@chezvivi.com and take effect on the date and time of receipt (Lisbon time).
- Refunds are made to the original payment method within 14 days.
- Date changes depend on availability and our acceptance; any price difference is settled when the change is made.
- There is no 14-day right of withdrawal, as this is an accommodation service for a specific date (Article 17(1)(l) of Portuguese Decree-Law 24/2014).
- If the unit becomes unavailable for reasons beyond our control (for example, flooding or a major breakdown), we will offer equivalent accommodation. If the guest does not accept, we will fully refund the nights not provided, without prejudice to any other statutory rights.
6. Check-in, check-out and guest registration
- Check-in from 15:00; check-out by 11:00.
- Check-in is self-service, through an online app, with access instructions sent before arrival.
- Early check-in and late check-out depend on availability and prior agreement, and cost EUR 30 each.
- Before arrival, all guests must provide the identification details required by law, including those needed to report foreign guests to AIMA, the Portuguese immigration authority (see Privacy Policy). Without these details, access may be refused.
- We may ask to see an identity document to confirm the details provided.
7. House rules
- The lead guest must be at least 18 years old and stay in the unit for the whole stay. Minors are only accepted when accompanied by a responsible adult.
- The maximum occupancy shown in the listing must not be exceeded. Only registered guests may stay overnight.
- Parties and events, smoking indoors and any unlawful activity are not allowed.
- Pets are not allowed, except assistance dogs as provided by Portuguese Decree-Law 74/2007.
- Guests must follow the building rules and not disturb neighbours, especially at night (23:00 to 07:00, under the Portuguese General Noise Regulation). Fines or costs caused by a breach are the guest's responsibility.
- Rubbish must be taken to the street bins and not left in the unit or in the building's common areas.
- In case of a serious or repeated breach of these rules, after a warning, we may require guests to leave, with no refund for unused nights.
8. Cleaning, bed linen and towels
The unit is cleaned before arrival and includes bed linen, towels and basic toiletries. Extra cleaning and linen changes are available on request, at a cost. Guests should leave the unit reasonably tidy on departure.
9. Damage and liability
- Guests must report any damage or fault immediately, even if they did not cause it.
- The lead guest is liable for damage caused to the unit, its contents and the building's common areas by them or other guests, beyond normal wear and tear.
- Items left behind are kept for 30 days and can be sent on request, at the guest's cost.
- We are not liable for interruptions to third-party services (water, electricity, internet) beyond our control, but will act diligently to resolve them.
- Nothing in these Terms excludes or limits our liability for wilful misconduct, gross negligence, death or personal injury, or any statutory consumer rights.
Each unit is covered by multi-risk insurance including civil liability, under Article 13-A of Decree-Law 128/2014, with an insurer authorised to operate in Portugal.
10. Changes to these Terms
We may update these Terms. Each booking is governed by the version in force on the date it was confirmed.
11. Governing law and jurisdiction
These Terms are governed by Portuguese law. The courts of the Lisbon judicial district (Comarca de Lisboa) have jurisdiction, without prejudice to mandatory consumer protection rules and to alternative dispute resolution, described in our Consumer Dispute Resolution Policy. If the language versions differ, the Portuguese version prevails.
